John R. Tunheim declares and states as follows:

1. I am a United States District Judge for the District of Minnesota
2. In 1993, I was nominated by President Clinton to serve as a member of a five person board, the Assassinations Records Review Board (“Review Board”), which from confirmation in 1994 until sunset in September 1998, enforced the provisions of the President John F. Kennedy Assassinations Records Collection Act of 1992 (“JFK Act”). I prepared this declaration as a result of my role with the Review Board which included serving as Chair of the Board for its entire existence. The JFK Act required all federal agencies to promptly identify all records in the agencies’ possession which related to the assassination of President Kennedy. The JFK Act broadly defined “assassination record” and the Review Board, by rulemaking, clarified and expanded the definition, using authority delegated by the Congress. The JFK Act further required that agencies promptly declassify and disclose to the public, pursuant to a legislatively prescribed deadline, all records identified as assassination records unless one of several narrowly drawn exceptions warranted postponement of their disclosure. The Review Board reviewed agencies’ identifications and releases, ordered further document searches and required additional disclosure of withheld information. As a result, over four million pages of records were transferred to the National Archives and Records Administration and released to the public with very limited information redacted, resulting in much less withholding than had been the case under previous Freedom of Information Act disclosures involving assassination records.
3. In unanimously enacting the JFK Act, Congress strongly indicated that it wanted all JFK assassination-related information to be released quickly. In support of the JFK Act, Congress made seven “findings.” Four of the seven findings stress the need to disclose quickly the information relating to the Kennedy assassination. Another finding made by Congress stated that all Kennedy assassination records “should carry a presumption of immediate disclosure.” Another finding notes that without the legislation, congressional records related to the assassination would not be available until 2039. Still another finding states that “the Freedom of Information Act, as implemented by the executive branch, has prevented the timely public disclosure of records relating to the assassination of President John F. Kennedy.” Another finding repeats the same point with respect to Executive Order 12356, which governed the classification and declassification of information which allegedly was required to be protected for reasons of national security.
4. In stating its purposes for enacting the JFK Act, Congress stated only two. The first purpose was to create the JFK Assassinations Records Collection at the National Archives. The second was “to require the expeditious transmission to the Archivist and public disclosure of such records.”
5. In line with its emphasis on speedy disclosure, Congress required that “[a]s soon as practical after the date of enactment of this Act, each Government office shall identify and organize its records relating to the assassination of President John F. Kennedy and prepare them for transmission to the Archivist of the United States for inclusion in the Collection.” For the same reason, it further provided that “[n]ot later than 300 days after the date of enactment of this Act, each Government office shall review, identify and disclose to the public, review by the Review Board, and transmission to the Archivist.”
6. The JFK Act was enacted on October 26, 1992. The Central Intelligence Agency thus was given until August 23, 1993 to identify assassination records in its collection, disclose them to the public, and transmit them to the National Archives. It is not nearly eleven years and nearly 4,000 days beyond the agency’s original deadline. Further, the JFK Act is still effective, despite the demise of the Review Board. The Act requires disclosure.
7. I am familiar with the thorough research done by Washington Post reporter Jefferson Morley on the assassination of President Kennedy. Utilizing disclosures made under the JFK Act, he has learned that the CIA was less than cooperative with the investigation of the House Select Committee on Assassinations in 1976-1978 and may have undermined the Congressional probe. It is imperative that all additional information which bears upon the CIA’s conduct regarding both the congressional investigation and the Kennedy assassination itself be made public as soon as possible so that Mr. Morley and others may continue to research these matters.

There are two important reasons why this requires dispatch rather than further delay in releasing the records Mr. Morley seeks. First, I am informed that Congress has depended on the input it receives from Mr. Morley and other assassination researchers in determining whether or not any additional inquiry may be warranted. Second, the passage of time has already made further investigation a difficult task. Many relevant witnesses, including the subject of Mr. Morley’s Freedom of Information Act request are now deceased. Others who may possess relevant information are elderly and as a result, the need for immediate disclosure is urgent.

And finally, the Congress has made plain its intent that assassination records be fully disclosed. The public interest in these records is extremely high and no reason exists for delay, particularly with records that are as old as the records that are being sought.

B. #805, Miami 1, Florida) (DRE) in Los Angeles, advised  SAs ROBERT H. KARL and WILLIAM J. MC CAULEY  on November 27, 1963 that according to Page 3 of “The Cuban Report”, English language publication, dated November 25, 1963 at Miami:

“The Cuban Student Directorate submits the following data on the background and activities of the prime suspect of the assassination of the President of the Untied States, JOHN F. KENNEDY. LEE HARVEY OSWALD….stayed in Russia until 1962, when he requested and obtained permission from the United States Embassy to return to the United States. Back in the United States, he lived in Fort Worth, Texas, and from there went to New Orleans to organize a delegation of the Fair Play for Cuba Committee. On August 21, 1963, Oswald and the Cuban Student Directorate delegate in New Orleans, CARLOS BRINGUIER, held a debate through the WDSU Radio Station of that city on account of a public disturbance acurred (sic) in Canal Street a few days before. On August 9, the delegate of the Cuban Student Directorate was walking through the streets when he saw an American spreading CASTRO’s propaganda and holding a sign that read, ‘Hands off Cuba’ and ‘Send food and medicines to Cuba, not comandos’ (sic). Three days before, the same man had visited the store where the offices of the Cuban Student Directorate are located. He asked for propaganda and offered his cooperation as a trainer in military tactics, as he had once been in the Marine Corps. Because our delegate, CARLOS BRINGUIER, found him suspicious, he did not give OSWALD a definite answer. Days after, he again visited our offices where this time he left a book entitled, ‘Guide Book for Marines’, with his name and army serial number written inside. When our delegate found OSWALD spreading on the streets Marxist propaganda published by the Fair Play for

Cuba Cuba Committee, they started an argument that ended up with the arrest of OSWALD, CARLOS BINGUIER, and his two companions MIGUEL CRUS and CELSO HERNANDEZ. They were taken to the police headquarters and released on a bail bond of $25 cash. The trial was held on August 12.

“When evidence on OSWALD”s attempt to infiltrate in our organization was presented, the judge charged him with a $10 fine for public disturbance and for attempting against the dignity of the City of New Orleans. CARLOS BRINGUIER was declared innocent.

“On account of this event, a debate on WDSU Radio Station was scheduled. The debators were LEE H. OSWALD, CARLOS BRINGUIER and ED BUTLER, from the Information Council of the Americas. BILL STURKEY (sic), acting as moderator, introduced OSWALD as the Chairman and explained that the main offices of said organization were in New York. We have tape recordings of the debate and other information that we will furnish to those who request it….”

DEETJEN pointed out that on Pages 1 and 2 of “The Cuban Report”, FIDEL CASTRO is quoted as having announced on “Sunday” that: “We are prepared to fight them and answer in kind. U.S. leaders should think that if they are aiding terrorist plans to eliminate Cuban leaders, they themselves will not be safe”.

DEETJEN added that a Spanish version of the above information is going to be read by himself to an expected audience of 100 Cuban refugees at a DRE-sponsored meeting in the Parish Hall of Our Lady Help of Christians, 512 South 29^th Avenue, Los Angeles, on November 27, 1963.

COPA is currently planning our 20th annual conference in Dallas which will mark the 50th anniversary of the assassination of President Kennedy and the 45th anniversaries of the murders of Robert F. Kennedy and Dr. Martin Luther King.

Our theme is: “50 Years is Enough! Free the Files – Find the Truth” and we will hold our events from November 22-24, 2013 in Dallas. We will have the leading researchers, authors, ballistics, forensic and medical experts who have worked on these cases over the last five decades and the best documentary films. We will hold our Moment of Silence on the Grassy Knoll at 12:30 pm on November 22 as we have for the past 49 years.

Among the confirmed speakers are Dr. Cyril H. Wecht, JD, MD (our founding president), Walt Brown, Robert Groden, David Talbot, Ernst Titovets (Oswald’s best friend in the USSR), and many others. Please plan to join us for our most important conference to date.

2017 Project – 2017 is when the JFK Act of 1992 requires all of the remaining government records related to the assassination of President Kennedy to be released to the public, unless specifically withheld by the President. The National Archivist is to certify to the President that all of the JFK Assassination records are now public. We will be organizing a series of events around this date in order to try to generate the remaining records be released before then.

Just because the NARA and CIA have told us no, they will not include the JFK assassination records in the 2013 National Declassification review as previously announced, they expect us to go home and come back in 2017. Well instead we are ramping up our efforts, continuing the petition drive, taking up a collection to put the petition in a full page ad in Washington and trying to convince Congress to hold JFK Act oversight hearings. It was with deep regret and some indignation that I read your comments regarding the JFK Assassination records that remain withheld, their numbers and the lack of any other cache of records someplace.

The article reports that, after quoting former governor Jesse Ventura that many JFK assassination records remain withheld, "...a prominent federal judge says all the evidence is out there and the verdict is in. In fact, assassination experts say virtually every known document is public. Minnesota Federal District Judge Jack Tunheim led an independent fact-finding commission in Washington in the 1990s to review, and declassify, millions of pages of documents related to the Kennedy assassination. Tunheim says all but a few of those documents are now public.”

In fact, all the evidence isn't "out there" and there are many thousands of records, especially CIA documents that are still being withheld, so many in fact that the National Archives and Records Administration (NARA) can’t count them or say exactly how many.

The article quotes you saying: “Is there a cache of records someplace? I don’t think so. We looked as far and as wide as we possibly could. It would have been a violation of law to not turn over records to us for our decision making. I just don’t think there was much left.’”

As you know, the ARRB, which you led, was unable to obtain many assassination records, especially those from the office of the Director of Naval Intelligence (ONI), the White House Communications Agency (WHCA) and former chief council to the House Select Committee on Assassinations (HSCA) Richard Sprague.

The failure of the ARRB to obtain and secure there records became apparent when some of them surfaced in private hands, including an edited but longer version of the Air Force One radio transmission from the effects of the President’s military aide Gen. Chester Clifton. Other records, including some from the director of ONI Rufus Taylor have also been located even though the ARRB could not get any records whatsoever from that office. Copies of Secret Service documents, thought to have been destroyed after the passage of the JFK Act were recently located among the private papers of a former agent (Gerald Blaine). And I am personally in possession of some original assassination records, copies of which were given to Richard Sprague when he was counsel to the HSCA, copies he kept after being forced to leave his post and records that are sill not among the JFK Assassination Records Collection at the NARA.

So, off the top of my head –  there are four“caches of records” that are someplace other than where they should be – the JFK Collection, and there are more that I will continue to list   until they are obtained and properly secured. I was especially dismayed to read your remark - “Tunheim says after many years of seeing all the available evidence — from Oswald’s rifle and bullets to Kennedy’s autopsy photos to FBI and CIA documents — he has not seen any direct evidence of any kind to change the verdict, which is that Lee Harvey Oswald acted alone.”

As you know there never was a verdict, there was no trial, Oswald was executed while in the custody of the law and you have not seen all of the available evidence, certainly not the documents still being withheld until 2017 or the “caches” that have been kept out of the JFK Collection, so you are not in a position to determine a verdict.

And as you certainly know, your job and the responsibility of the ARRB was not to investigate or even find “facts,” but to locate, secure and release to the public the government records on the assassination, a job that remains unfinished now over twenty years after Congress passed the JFK Act of 1992.

It has been over fifteen years since Congress conducted the mandated oversight hearings on the JFK Act, which when it happens, should document for the record all of the JFK Assassination records that were destroyed, are missing or remain withheld.

You say "it would have been a violation of law" for such records to be kept from the review board, but that's exactly what happened and that law has yet to be enforced and probably never will unless you see to it. 

The next time you are questioned by reporters about the JFK assassination records, as a judge you should know not speculate as to the guilt or innocence of Oswald or the accuracy of the Warren Report conclusions, but instead call on the NARA to enforce the JFK Act, to determine the exact number of documents that remain withheld, to include the JFK records in the 2013 National Declassification review and get Congress to conduct necessary oversight hearings on the JFK Act so the work of the ARRB can be properly evaluated.

One of the reasons Congress passed the JFK Act was to increase the public's confidence in their government, but the continued failure to release these records has only increased the citizen's distrust of their government, of which you are a part. 

Twenty years after, you should be the one asking the questions.

How many assassination records were destroyed?

How many JFK Assassination records remain withheld?

How many of the ARRB recommendations have been enacted?

Where are the assassination record “caches” that are not part of the JFK Collection?

Why won’t Congress or NARA properly oversee the JFK Act and hold hearings?

If you could get answers to these questions then you will have completed the job you began over two decades ago and remains unfinished.

The Great JFK Scavenger Hunt is On!

What gems of the missing and secret Family Jewels are still out there, in a basement file, in a box in a garage or attic or suitcase under a bed or in a closet?

Maybe its owner has died and it has been passed on to unknowing relatives who don’t even know its there?

Not real gems, but historical documents, records and artifacts related to the assassination of President Kennedy.

It is quite apparent that with the discovery of the previously unknown Clifton copy of the Air Force One transmission tapes and the acknowledgement by former Secret Service agent Gerald Blaine that he had copies of the Tampa advance reports that were said to have been destroyed, some historical records have escaped destruction and there are still significant government records related to the assassination of President Kennedy that are still “out there.”

Top Ten Missing Items 

1)      The original, unedited reel to reel audio tape recording of Air Force One radio transmissions on November 22, 1963. An edited cassette version was released by the LBJ Library in the late 1970s and a longer, but still edited version was recently recovered from among the effects of US Gen. Clifton, the President’s military aide.

2)      Complete transcript of the unedited audio recordings of AF1 radio communications on November 22, 1963. This document was known to exist because a number of journalists, including T. White and William Manchester, were permitted to read it while visiting the LBJ White House and former JFK cabinet member Pierre Salinger was permitted a copy while writing his memoirs.

3)      The ONI records related to the assassination of ONI Director Rufus Taylor, who is known to have exchanged extensive memos and letters regarding Lee Harvey Oswald, his navy career and activities in Texas and Louisiana previous to the assassination. Although samples of documents of Taylor’s assassination files have been located and released from the files of other agencies, the Navy maintains that they could not locate any of Taylor’s records related to the assassination. This might take a WikiLeaks type of insider cooperation or someone who maintained them or some of them.

4)      RFK’s datebook diary for the year 1963 is missing from the records of RFK’s secretary at the JFK Presidential Library. This had to take someone very connected to purloin and for good reason – most likely to conceal RFK’s meetings and phone conversations with anti-Castro Cubans in the months and days leading up to JFK’s murder. The suspects are limited as to who took this and has it today, if it wasn’t destroyed.

5)      George DeMohrenschildt’s film and report to the government of his 1961 walking tour of central America where he stumbled across the anti-Castro Cuban commando training camp of those destined for the Bay of Pigs. DeMohrenschildt says he filed a report to a US government agency about this trip, and even asked President Kennedy to write the forward to the book version of the report, but it is not among the government’s assassination, and neither is the home movie type film of the trip.

6)      The film clip of the anti-Castro Cuban commandos training at a Louisiana camp, which former House Select Committee on Assassinations (HSCA) investigator Tannenbaum viewed after it was retrieved from the library at Georgetown University. Tannenbaum believes that Oswald and David A. Phillips can be seen in the film, which is not among the government’s records today.

7)      The “Wink” photo negative of LBJ aboard AF1 moments after his swearing in. While hard copies of this photo have survived, the negative is missing from the vaulted records at the LBJ Library.

8)      JFK’s missal. LBJ was not sworn in on a bible, but JFK’s Catholic Missal book of prayers, after which the Judge handed to someone next to her, the last it has been seen. But it must have been taken by someone who was on the plane, probably one of those local Texans who got off the plane after the swearing in, a very short list of suspects.

9)      Autopsy x-rays, photos and possible film of the autopsy. Those military technicians and official photographers who took the photos at the autopsy claim that the photos now in evidence at the JFK Collection at the National Archives (NARA) are not the ones they took. Where are the originals? And did a Bethesda film and video technician record the autopsy as it occurred?

10)  JFK’s brain. While most of those who saw the president’s head say that half the brain was blown away, autopsy records show there were two, post autopsy brain exams, the brain wasn’t buried with the body and at least one vile labeled JFK’s brain was passed on through administrators and flushed through a food processor. It is possible that portions of JFK’s brain were placed in the casket by RFK during the secret 1968 exhumation, a military operation conducted at night.

11)  Some LBJ telephone and oval office audio recordings of conversations were said to have been destroyed, and some are missing, and we know because the transcripts have survived but not the tapes, which someone in the LBJ administration may have privately saved, as one of his secretaries was known to have saved everything.

If you think that these items will never be found or don’t exist anymore, then consider the following examples of items that were ordered destroyed or were headed for destruction and were saved by good and honest people who recognized their historical significance.

TOP JFK ASSASSINATION RECORDS SAVED

1) New Orleans Grand Jury records and transcript of testimony, which DA Harry Connick had ordered destroyed but were instead saved and passed on to the Assassination Records Review Board (ARRB) after the passage of the JFK Act.

2) Andrews Air Force Base Log book for 11/22.63 and the day RFK was shot. A special book keeping track of all related incoming and outgoing plane traffic was kept for both days, in the same book, which was saved from being disposed in a dumpster by a base civilian employee and turned over to the ARRB for inclusion in the JFK Collection.

3) Clifton Air Force One Tapes. Despite the assertions of the LBJ Library and the White House Communications Agency (WHCA) that no such tapes exist, two reels of the AF1 radio communications of 11/22/63 were discovered among the effects of the late Gen. Clifton, the President’s military aide. The discovery of these tapes give rise to hope that the original tape still exists and will be found.

4) Secret Service advance reports for Tampa and Chicago, said to have been intentionally destroyed by the Secret Service after the passage of the JFK Act, were found among the private papers of former SS agent Gerald Blaine, who wrote about them in his book. These records were turned over to the NARA for inclusion in the JFK Collection but are not yet available to the public.

5) When Richard Sprague was fired as the first chief counsel to the HSCA, he took his office files with him and didn’t turn them over to his replacement, G. Robert Blakey, and good he didn’t because Blakey had all of the HSCA records locked away and they were sealed until the JFK Act was passed. Although the ARRB was notified of this, they never sought to reclaim Sprague’s HSCA records and he ostensibly still has them.
